A few checked facts worth knowing
- Appointment A producer may not act as an insurer's agent or bind coverage for it unless that insurer appoints the producer. The license alone creates no actual, apparent or inherent authority. An agency is appointed only after an affiliated individual producer holds the same qualification and is appointed by the same insurer. (MCL 500.1208a(1)-(2), 500.1201(h); DIFS, Appointments / Cancellations)
- Claims timing The insurer specifies in writing the materials that make satisfactory proof of loss within 30 days after receiving the claim. Benefits not paid on time earn simple interest at 12% a year, starting 60 days after satisfactory proof was received. (MCL 500.2006(3)-(4))
- Loss settlement Buildings are settled at replacement cost without depreciation if insured to at least 80% of replacement cost. Example: home worth $300,000, insured for $180,000, covered partial loss $30,000: required $240,000; 180/240 = 75%; payment $22,500. (ISO DP 00 03 12 02, Conditions; ISO HO 00 03 05 11, Sec. I Conditions D.2.b)
- Conditions Notice of an occurrence as soon as practicable; send suit papers immediately; no voluntary payments. Premium audit: advance premium is a deposit. Nonrenewal: notice at least 30 days. Bankruptcy of the insured does not relieve the insurer. Others may sue the insurer directly only to enforce a settlement or final judgment. Other insurance: equal shares if all permit it, otherwise by limits. (ISO CG 00 01 04 13, Sec. IV)
