A few checked facts worth knowing
- HO-2 Broad Form The dwelling and other structures are insured on a named-perils basis. The HO-3 and HO-5 insure them against direct physical loss (open perils). (ISO HO 00 02 10 00, Sec. I, Perils Insured Against)
- Newly acquired autos Under the personal auto policy, the insured must ask for coverage within 14 days of becoming the owner when the Declarations show collision coverage on at least one auto. (ISO PP 00 01 09 18, Definitions, your covered auto)
- Unfair claims settlement practices An act listed in 33-6-34 is an improper claims settlement practice if committed flagrantly and in conscious disregard of Title 33 or its rules, or with such frequency as to indicate a general business practice. Examples: failing to provide claim forms within 15 calendar days of a request, and compelling insureds to sue by offering substantially less than the amounts ultimately recovered. Sworn statements permitted by the policy, written denials with explanations and prompt payment are consistent with the Act. (O.C.G.A. 33-6-33, 33-6-34(11), 33-6-34(5))
- FAIR Plan: approval The plan and articles take effect ten days after the Commissioner approves them. After a partial disapproval the directors submit a revised plan within 30 days, failing which the Commissioner promulgates it. (O.C.G.A. 33-33-4(b))
